Stack v Dowden principle not limited to domestic context: parties' intentions are key (Privy Council)

In Marr v Collie (Bahamas) [2017] UKPC 17, the Privy Council clarified that the principle in Stack v Dowden [2007] AC 432, that beneficial ownership follows legal ownership unless the contrary is proven, is not limited to a domestic context and can apply where the parties’ personal relationship has a commercial aspect. Context is key and is informed by the parties’ common intentions.
